(NOTE: The co-option of MY copyrighted musical works, by iTunes, Apple, Microsoft and Windows Media, and these entities assumption of legal basis for having done, and doing so, evidenced by the lack of licence exception for personally produced independent intellectual property,is a separate Class Action, with a MUCH more easily defined set of illegal infringements upon Independent Artists by the aforementioned media concerns.  It will be addressed forthwith.)

The Berne Convention for the Protection of Literary and Artistic Works has protected the copyrights on literary, scientific, and artistic works since 1886. Article 9 of the Convention states that: Authors of literary and artistic works protected by this Convention shall have the exclusive right of authorizing the reproduction of these works, in any manner or form. [...] Any sound or visual recording shall be considered as a reproduction for the purposes of this Convention.[7]

Under the Berne Convention, when a composer puts a new song in a "fixed form," for example sheet music or an audio recording, copyright law grants them the exclusive right to control who may perform that song (called performing rights) as well as control over how any derivative work is used, such as a recording of a performance of that song. These rights are retained for at least 50 years after the composer's death (typically longer). In some cases, if the song being performed is in the public domain or is free content and is performed faithfully, no copyright is violated by recording it; however such a recording may still violate performers rights, a type of neighboring right that is recognized in many nations. Where they exist, performers rights may have a shorter duration than full copyright; for example, the Rome Convention sets a minimum term of twenty years after the performance.

Most artists have made little effort to pursue legal action about bootleg recordings, viewing such "rarities trading" as harmless provided that it is not being done for profit. The benefits of interfering with such trading are fairly minimal compared to the potential ill-will generated against the artist, as the illicit works are generally circulated among the artist's most loyal fans, which have the most interest. Most record companies also have not shown an interest in pursuing or prosecuting small-scale bootleggers, but this could change at any time.

In 2004 U.S. District Judge Harold Baer Jr. struck down a 1994 law banning the sale of bootleg recordings of live music, ruling that the law unfairly grants a seemingly perpetual copyright period to the original performances.[10] He dismissed a federal indictment of Jean Martignon, who was running a Manhattan mail-order and Internet business that sells bootleg recordings. The Recording Industry Association of America disagreed with the ruling, saying the decision "stands in marked contrast to existing law and prior decisions that have determined that Congress was well within its constitutional authority to adopt legislation that prevented trafficking in copies of unauthorized recordings of live performances", according to spokesman Jonathan Lamy.[11] In 2007, Judge Baer's ruling was overruled, and the United States Court of Appeals for the Second Circuit found that the anti-bootlegging statute was within the power of congress. 492 F. 3d 140
Fair Use Defense:

Turning to the question of fair use, the Circuit court agreed with the district court's "general analysis of Napster system uses" as well as with its analysis of the three "alleged fair uses identified by Napster" -- which were "sampling, where users make temporary copies of a work before purchasing; space-shifting, where users access a sound recording through the Napster system that they already own in audio CD format; and permissive distribution of recordings by both new and established artists."

The court first considered four factors on an abstract level of the system itself; of which #3 is salient, on point and now constitutes legal precedent and accepted case law:

3) They considered the potential that in some cases, wholesale copying of a work may be protected, noting time-shifting as an example.

The court then turned to the three uses Napster identified as fair use in the conduct of its users; of which, #s 2 & 3 are salient, on point and now constitute legal precedent and accepted case law:

2)  space-shifting, where users access a sound recording through the Napster system that they already own in audio CD format; here the District Court found that neither of the shifting analyses used in the Sony or RIAA v. Diamond Multimedia[9] cases applied in this case because the "shifting" in neither case included or enabled distribution. The space-shifting argument did not succeed because, while the shift to a digital format may have been a personal storage use, it was accompanied by making the file available to the rest of the system's users.

[NOTE: Such is NOT THE CASE IN THIS CASE, because in adhering to the legally accepted conditions of R.O.I.O. acquisition, as decided in this and "Sony or R.I.A.A v. Diamond Media", for the private users of "DimeADozen" aka: "EZTorrent"; "shifting" of R.O.I.O was allowed by the artists, who had absolute authority to ban any R.O.I.O. of any and/or all of their performances, ever, which policy was then rigorously adhered to by the Administration and "Moderators" of said site, including the prohibition of posting any incidence of a specific recording of a specific performance from a specific source, independent or not, that had EVER been commercially released in production quantities, bootlegged or not.

The digital file quality of the music comprising the only allowed format for tracking, "lossless" (.wav, .shn, .flac, .APE,.aiff etc) so completely demonstrated the recordings origins, through digitally irrefutable waveform analyses (even generations of cassette tape to cassette tape transfers were identifiable) that no recordings of any "for sale" files were allowed to be tracked, or accessed by users. Scrupulous records were kept, and vast databases of 'released' material maintained to guarantee the legality of both the site, and it's user's utilization thereof.]

[It might also be noted that most of the users were audiophiles who preferred the non-compressed audio quality of "lossless" recordings to the "tinny" timbre and 'lifeless' ambience of commercial (MP3) recordings, which comprised only 1/10 (10%) the audio data of the original recordings, the aforementioned (.wav etc.) 'lossless' digital (or analog) recordings.  Many of these recordings were from the musicians themselves, who agreed that archiving historically important recordings whose media (magnetic tape) had degraded beyond any sound recall, amongst aficionados who could not even fit 2 or 3 lossless CDs into an iPod (as opposed to hundreds of the 'junk' MP3 music files - the better to create profits for recording companies) constituted a type of digital "seedbank" as it were, of some of the most important music of the 20th Century.]

3)  permissive distribution of recordings by both new and established artists who have authorized their music to be disseminated in the Napster system, which the District Court ruled was not an infringing use and could continue, along with chat rooms and other non-distributory features of Napster.

By contrast, the court found that the owners of Napster could control the infringing behavior of users, and therefore had a duty to do so. (As IS BEING DONE ON DimeADozen) The Ninth Circuit affirmed this analysis, finding that the plaintiffs were likely to succeed in proving that Napster did not have a valid fair use defense.

Contributory Infringement
In order to prove contributory infringement, a plaintiff must show that a defendant had knowledge of infringement (here, that Napster knew that its users were distributing copyrighted content without permission across its network) and that defendant supplied material support to that infringement.

Knowledge.   The District Court ruled that the "law does not require knowledge of 'specific acts of infringement'"[1] and rejected Napster's assertion that, because they could not distinguish between infringing and non-infringing files, they did not have knowledge of copyright infringement. The Ninth Circuit upheld this analysis, accepting that Napster had "knowledge, both actual and constructive, of direct infringement."

(As noted above, every .torrent and every audio file submitted for tracking on "Dime" is subject to digital scrutiny far stricter than even Treasury counterfeit inspections - fake money spends the same, but no member of the Dime" community" would stoop to even lend an ear to the 'mass market' soundbytes that pass for commercial music these days, and that's a fact!)

Additionally (pursuant to slight differences between the lower court's & the Ninth Circuit's Appeal ruling): 
Unlike Judge Patel, the Ninth Circuit accepted that "Religious Technology Center v. Netcom" might be relevant. Based on that case:

"We agree that if a computer system operator learns of specific infringing material available on his system and fails to purge such material from the system, the operator knows of and contributes to direct infringement. ... Conversely, absent any specific information which identifies infringing activity, a computer system operator cannot be liable for contributory infringement merely because the structure of the system allows for the exchange of copyrighted material."

The "Vicarious Infringement" claims are inapplicable to Dime, because it is solely vonuntary donation supported.

Oddly:

In its defense against the injunction, Napster also cited the Audio Home Recording Act (17 U.S.C. §§ 1001-10).[10] and the Digital Millennium Copyright Act's safe harbor clause (17 U.S.C. § 512).[11] The Ninth Circuit agreed with the District Court's finding that downloading MP3 files is not covered by the Audio Home Recording Act. The Ninth Circuit disagreed slightly with the District Court on the safe harbor issue, however, finding that the contributory infringement does not necessarily exclude a party from safe harbor protection. The court held that the safe harbor issue would be explored further at trial.[1]
(NOTE: lossless digital recordings of "tape" sources, ARE COVERED BY THE ACT, and legal for home use!)

Criticism and Impact
Among a number of amicus briefs filed on behalf of both sides of the dispute, one particularly critical brief filed by a consortium of eighteen copyright law professors at United States universities argued that the District Court misread Sony and took too narrow a view of fair use. They wrote:

"Napster is the best-known example of a new technology deploying what has come to be called peer-to-peer networking, a system in which individuals can search for and share files that reside on the hard drives of other personal computers connected to the Internet. Peer-to-peer file sharing allows individuals to bypass central providers of content and to find and exchange material with one another. The decentralized model of peer-to-peer networking poses a significant challenge to sectors of the entertainment and information businesses that follow a model of centralized control over content distribution. However, this is not the sort of challenge that copyright law is designed to redress. The district court’s ruling would ban a new technology in order to protect existing business models, and would invoke copyright to stifle innovation, not to promote it.[12]"

The professors further argued that the overbroad nature of the injunction threatened the development and deployment of any future peer-to-peer file-sharing network on the Internet because it insisted on a restructuring that defeated peer-to-peer technology itself. They also argued that the finding of contributory liability was erroneous because of Napster's significant non-infringing uses and because not all unauthorized uses within the system were infringement. They concluded, " If Plaintiffs want copyright law extended to allow the suppression of new technologies, they must make their case to Congress."[12]

DIME has a zero-tolerance policy against the sale of bootlegs. Collecting revenue for the works of performers without proper compensation to them is unethical and impardonable.
Users lose access to the tracker if they are found to be engaged, involved, or cooperating in the sale of bootlegs, whether or not any of their offerings can be traced to DIME torrents. Any donations they had made are forfeited.

Dubitable cases will be resolved ex cathedra by DIME management. Use of DIME is neither a civil right nor a necessity to life, and management reserves the right to refuse access to anyone for any reason at its sole discretion.

The Book Of Ruth, was what I thought the subject of my receipt of a letter in Greek, apparently, because on
FaceBook recently I said I could prove that EVERY word in our English Translated Bibles was NOT
translated truly, whole passages of The Song Of Solomon were censored, and Ruth's mother did
NOT tell her to uncover Boaz's "FEET". I thought his evidently spurred some poor soul to take
umbrage and harangue me in a foreign language I quit the Seminary rather than learn - Oh,
but then RUTH WAS NOT ORIGINALLY WRITTEN IN GREEK, WAS IT?  Hmmmm.
A good book for explaining the thousands of years of editorial drift in the texts of the Torah & the New Testament is:   "The Harlot By The Side Of The Road". 

I mean modern Christians break a Commandmant whenever
they worship on Sunday, because they don't "Remember the Sabbath, to keep it Holy", and any
Hebrew scholar will admit that the word the Catholic Church translated as 'virgin' actually
means 'young woman' NOT 'virgin', but they only remind other jews of that. They got tired of
trying to convince the spitefully diputative 'goyem' religious fanatics (who used to burn
them at the stake for speaking it) that they knew their own language better than a bunch of
Pagan Romans. Now I've offended everybody, so be it.

BTW, also, for all those rational folk who have cursed be as a "tweaker"(even FaceBook
staff) my diagnosis after the years of LSD the MKULTRA program fed me (and my own
writer/musician alcohol habituation, now just a memory), given to me over the course of a
decade by three PhD shrinks/neurologists was: "Occasional periods of episodic Unipolar
Mania."

I can have weeks where I'll just catnap an hour or two every 10, it is not uncommon among
those abused by our government with experimental dosages of whatever it was they gave us to
test. Read the literature, my dears, you might be surprised. Also, I remember my Pawnee
Marine Korean War Vet CIA handler and his squad buddies would sometimes stay
up for 4 or even 5 days without sleep, no drugs but alcohol and nicotine involved. They
taught me some tricks towards maintaining a state of 'hypervigilance' that were necessary
for their 'counterinsurgency' infiltration activities (although the 'insurgency' they were
infiltrating was Timothy Leary's "Brotherhood Of Etenal Love" - figure . . . go);{>
 
So just because I write about drugs, because they were a part of my life doesn't mean I have
to use them anymore to stay awake and "on a roll" writing for a night or two, and it is
mean-spirited and self-righteous of anyone to assume that is the case. I also have a broken T-1
vertebrae - industrial accident in '72 - I collect NO disability, never stopped me from
working or writing or playing, but it makes it hurt to type, my hands go numb, and it too
keeps me awake. 

I'm sure you don't care about that, or even believe me, as will others
neither, and I guess it's all part of the PR persona of the lead singer/guitarist for "THE
CHUMPMONKS" (GREATEST BAY AREA ROCK BAND NO-ONE EVER HEARD) & author of the GREATEST AMERICAN MEMOIR WRITTEN (in 60 spiral notebooks I've been lugging around for years) BUT NOT YET PUBLISHED. If I were some Evangelical Saint would people believe my story? I think not.
 
Nevertheless, my statement stands. I am NOT fluent in either Greek, or Aramaic, AND NEVER
CLAIMED TO BE, but I have stuggled to puzzle out a few things over the years, with the help
of some fine, non-judgemental Jewish & Christian scholars, who were not put
off by the questions of a Fundamentalist's 'Preacher's Kid", who seriously wanted to learn,
"the truth".  The letter turns out to be in Russian, and I may have just bought shares in an
herbal viagra company.  That's what the previous post was about.  A Persian wedsite was blamed for
the stuff  they say I picked up cruising porno sites (SOP) after the insallation of my latest Virus Program.  I just got it and showed it to MacAfee & Microsoft.  Most foreign intell knows I think half of our
domestic Intel programs are run by fascists, AND I am NOT prejudiced toward ANY country or
religion.  But I AM an AMERICAN FIRST so, tease the bull and you'll get the horn.

I get harassed so much by right-wing 'script kiddies' and conservative government intelligence
agencies, who hack me unmercifully and never seem to realize THAT"S WHAT I"M HERE TO DO!
Provide a perfect target for clueless software hackers who are observed at every stage.  I never learned
programming because I'm an actual "electrokinetic" adept.  It came along after MKULTRA, and 
REALLY freaked a number of folks out.  I just have an "intuition" of hacks, badscript and even foreign
incursions, and can mentally surge 'electronconstructs' through  'twisted-pairs', heavy guage or fiber.
 I was the initial alert of the DNS attacks on the US Internet  the eve of the first Gulf War.  I had 100 pgs of WhoIS docs in the mail to the FBI the next morning

I have BetaTested 25 years worth of sofware for everybody from Captain Crunch (I used to sell "Blue Boxes" in Berkeley in the '70s) to NASA, often inadvertently.   I am followed everywhere online by the guys who wrote the first code, BEFORE compiler languages - guys who stayed .up for weeks with catheters in and cases of Jolt Cola close at hand.  Spooks still use me to train new geeks ("seriously irritate the old hippie dude and we might get to see a modem melt" - I have 4 "Fusion Certificates'  issued to me to date).  I have actually been protected, employed and utilized by the 'Ethical Swordfish' groups and my old "Company" contacts to "seek and destroy" rogue behavior-mod ops since the '70s.  When I talk about my "Angels" I mean three things, I grew up with an ex-HA who pulled a bully off me in third grade, I have crackers that use me for bait while the "Company" is never far AND I have had two actual 'cherubim' as "Spirit Guides" since birth (confrmed by MANY respected psychics).

Skepticism As An Asymptotic Function Of Knowledge

Ancient, and recent, beliefs and discoveries about Matter, and Space and Time, correspond with such a plenitude of congruence that I and many other "New Age" types, often wonder just why our collective understanding as a species, our 'world-view' (Ger.: Weltanschauung) as it were, has apparently been so thoroughly and effectively overwhelmed for the past few millennia by the "Cognitively Dissonant Self-Limitation Eschaton Paradigm", as I call it, which, when looked at from just the right philosophical perspective, can be seen to have been actively preventing our evolutionary growth as a functioning collective body of biosphere consciousness. Hence, given our penchant as a race for looking beyond our own species for such alternative paradigmatic input, when some of us seem to think that human history has been shaped by the influence of sentient beings, civilizations, and technologies not native to this planet, the clamor of opprobrium and derision these assertions are met with seem quite a bit too strident for supposedly "unbiased" skeptics. So automatic is the response that it is almost tantamount to evidence of some attempt at suppression of the entire concept that we are not alone in the universe, and as such are affected only by what we believe we perceive with our five senses. Yet, when one studies physics, one realizes that our senses DO NOT accurately capture the totality of existential phenomena, yet most human beings think they know what is "REAL" and what is not - but, based on the last 50 years of scientific research, they DO NOT, and yet most still believe they do. Perhaps because they have been "taught" to reject certain conclusions about the nature of personal reality for reasons to which they are not privy, perhaps because if people were aware of forces manipulating mankind with other than mankind's best interests at heart, they might resist and thereby interfere with whatever agenda is in place.

The "Behavior Modification" Of American Government And Culture

Well, I was careless recently and didn't back up about 30 minutes worth of 'automatic writing' - containing a quite detailed explication of the famous Frank Olson CIA case and how he was actually murdered (read: "thrown", not "jumped" out the 10th story window of a bordello/'safe house'/Himmleresque experimental facility) by minions of the "Bundesnachrichtendienstengeisten". The continuation of the Third Reich re-established in stealth in America, and elsewhere, by the flow of Capital from German Industry. The ruling class knew the Reich would fall, but always planned that the future of World History and the plutocratic hegemonies that would shape it be dictated by Prussian Disciplinarian Policy and Ideals in any event.

Thus the 650 + scientists military officers and “Drs.”, war criminals all, with new identities given them by the US Govs. “Intelligence Community” in “Operation Paperclip” at the end of WWII when Obergruppenfuhrer Reinhard Gehlen convinced FDR, Hoover, Eisenhower and MacArthur, through Patton (The Real "Manchurian Candidate") to form the NSA there and then (all historic fact - look it up) Patton to prevent certain salient details of the Nazi infiltration of our Government, Military-Industrial Complex (Ike knew enough to try to warn us in his farewell address) intelligence community and scientific/research community from coming to light.

Frank Olson’s death was just ‘collateral damage’ in the cover up of (literally!) thousands of “crimes against humanity” by Project Monarch/ MKULTRA/Whitecoat OSS ops unnamed, etc. operations: kidnappings, rapes, maimings, murder and ‘terminal experiments’, sexual torture, systematic experimental child abuse, infections of thousands of American citizens on and on even unto the hundreds of CIA "snuff" flicks of the terminal experiments and worse.

The infiltraitors and their scions all secure in their belief in their own successful redaction of the facts from History (read: 'the propaganda of the ruling class') and marginalization of all who question the "status quo uber alles", until the advent of "Channels" and "Mediums" who really could get info from anywhere (even classified files) delivered right into their minds. No wonder the 'takeover' of the largest Michael Teachings Website, by forces opposed to the truthful rendition of facts regardless of the supposed "National Security" implications.

The full and true tale of how Frank’s Olson's son sued the CIA and the Federal Government in the late '60s and prevailed, winning his 'wrongful death' case in 1970 by having a Fed. Court order the release of a large number of pertinent documents which substantiated his claims (an unheralded act of Angelic Intervention, by a few of the "Fallen" actually, and you'll not hear this ever, from any but I. Forever branded as "evil" by vain History, again and again they interceded, unthanked and unheeded, but Gaia, and I, remember!) will be told, and many more.

These unexpected events led to a mad scramble to cover up EVERYTHING because (as none in power realized) "Pandora's Box" (and Fort Knox) had been compromised by agents both invisible and non-human (more on this anon). Disinformation on top of denials under smokescreens of "National Security" as Richard Helms was replaced by Stansfield Turner AFTER Helms and Himmler trained aides and "goodfella" crews destroyed a couple of bunkers filled with semi-tractor trailors full of documents, tapes, movies and more (as well as those things redacted/hid/given/snatched by their Mafia brethren as "get out of jail free" cards if ever needed).

This "chrystallnacht" of evidence is now only the stuff of whispers between aged dons in back rooms in Henderson retirement homes, a pall-like cloacal miasma of cigar smoke and human misery sticking to their souls, moustaches and slippers. I may have a few good years left in me to "set the record straight" about what has happened since the last significant works about the continuing predations of the American "Intelligence Community" (and they DO still continue, even though there is now a significant and visibly ethical partition of even the rarefied strata of cabals 'above' the NSA, and the Prussian Model has been rejected by a smaller, but more effectively powerful and futurehistory allied and protected portion of almost all the agencies, covert and overt.)

The spectre of 'George White', a figure of diabolic proportions in the founding of the OSS, and then MKULTRA and the CIA/NSA apparatus as designed by the 'ubermenschen' of the SS, still hangs over me, personally. He personally was responsible for cruelties to family, and people I loved.
As he once stated, for the record, his career from WWII on to his supposed 'retirement' in '65: " . . . was fun, fun, fun. Before I was twenty I became slowly aware of the enormity of oppression of citizens worldwide by their governments, and the many lives and possible futures at stake. Remembering the struggle WB Yeats (may have been my incarnation immediately prior to this one) had defined as "The Machine" vs. "The Garden" I stumbled into the futures running on fear and impelled by my faith in Chaos Theory to provide opportunities for social change.

On this reflective rumination my training 'on watch' began in '73 with "Scotty" back from The City, 20 lbs of Air America CIAfghan hashish, a copy of the nascent "Gemstone Files", and the deadly 'blackhole" auricstink signature of "George White", retired but still schmoozing with his pals at their favorite SF bar, where they could always hang out to hoist a few, and drug, kidnap, rape, torture, maim and discard various members of SF's ever unsuspecting hippie society.

These spooks were members the same cabal of people who were eager to assassinate Sen. Estes Kefauver, by poisoning a slice of apple pie with 'sodium morphate, and have him then collapse ON THE SENATE FLOOR! To demonstrate thus to the 'do-gooders' opposing (and eventually in internecine pursuit of them) that they should 'back off'. I believe this incident was responsible for the Kennedy assassins and Nazi superiors feeling they could get away with ANYTHING later in Dallas, and was the turning point in the “Extremism in the defense of Liberty is no vice.“ death knell of Democracy and subsequent well-funded moral and ethical demise of American Government.

The Third Riech's rationale for human experimentation was embraced by a majority PART of the U. S. Military, Intelligence Community, Legislature Judiciary and Executive Branch at this point as the 'Dachau Dolls' slithered into the undefined interstices of the ruling class's lackey beauracracy, vanishing with nothing but a slime trail of contumely left behind, and never again did the "Shadow Reich" feel compelled to inform subsequent Presidents/Judges/Legislators about their
'Bundesnachrichtendienstengeisten' activities. Their Credo had been expressed for all to fear by Barry Goldwater in his famous statement, cited above, rationalizing their Himmlerian/Mengelen amorality.

Some spirits can be vengeful when interfered with in pursuit of a discarnate search for justice. I've never been able to shake the feeling that millions of the victims of TRULY evil men like: ‘George White’ (SS to the core, NOT American) or Maitland Baldwin or Kurt Plotner or Walter Neff or Winfred Overholser or Gen. “Wild Bill” Donovan or Richard Helm or Stanley Lovell, et. al. still wish the truth of just how much the of the Third Reich escaped Nuremburg and then subsumed America's leaders and culture might be told!

Here in the next few years, after my 6 decades of abuse and damage and revelation and preparation and pain and something akin to an aspiration towards an apprehension of wholeness, and the weight of the world's pain for the Holocaust, and more, I shall endeavour to tell the stories that the myriad friends of mine (and those I never knew) who died in their struggle to free themselves from the yoke of mental, emotional, psychosexual and philosophic oppression that America’s rulers placed upon us (WHEN MOST OF US WERE CHILDREN, REMEMBER) in the search for “Behavior Modification” to "combat communism", would tell if they could.

Some can still reach from beyond the grave I recently realized - Woody Guthrie evidently still smoulders somewhere on the Astral Plane, hoisting mugs of "Old Ectoplasm" beer in the heavenly IWW Hall with Joe Hill, and Huey Long, toasting the martyrdom of Leon Trotsky and Sacco and Vanzetti and the Rosenburgs.

At least that's the way this Sage has seen it since before even the "Word" began the expansion of the last Singularity. But what do I know? I speak from long experience about believing that just retribution for all cruelties we, the Children Of Light, have suffered WILL manifest, one way or the other, and sooner rather than later. Maybe because I "hunger and thirst after righteousness", or perhaps 'cause there once was a boy who believed, and continued lifelong to feel, that one of his 'multiple personalities' was some sort of "Arbiter" (he knew the word before the meaning) lifetasked with resolving an arcane and longstanding point of metaphysical dispute. Now then, this boy, grown to a much older man, might just (have planned) to happen to be in an appointed place at an appointed time with an appropriate surrajoinder prepared airtight and waiting to be applied with the proper kind and degree of force, through the proper medium to the proper object! Et voila: "Instant Karma"! Just like Magick! (It may even be the prophesied: "hard rain's gonna'fall".)

As always, as proponents of change we all have faced the same verities as our tormentors. I have NO idea why I've survived this long, to be here, now. I know many better folk have fallen, and passed on. I attempt to 'keep the faith' and champion causes like "Social Change Through Freedom From Wage Slavery" and quaintly axiomatic cultural notions like "Truth, Justice and the American Way", and "Peace, Love and Good Vibes".

Obviously, to me, the current "Great Recession" is a media/government economist defined event, I just think world economics are manipulated by the ruling class, and as such all these predictions of worldwide economic collapse because of deficit spending (by WHICHEVER of the two parties are currently supposedly "in power") are just attempts to prove the other side wrong, because nothing a single government can do is ever going to change the fact that global economic effects are rarely influenced by anything other than a completely secret hegemonic consensus of the weathiest individuals and corporations.

I've thought about and studied this subject for 40 years, and the "truth" as I see it, must delineate 'causes" from 'effects', and you can't do that with a 'sound-bite'. Here we go then, as THE Firesign (Theatre) put it:

This is where and when I believe the system of mass control of worldwide human evolution becomes 'self-aware', in a sense, with Locke and Hobbes, and Paine's "Age Of Reason" ; and so, with the contraindicative dispositive dialectic of capitalism, feudalism, with its "Divine Right Of Kings", devolves/evolves into the plutocratic and oligarchical hegemonies that today are nation-states and multi-national corporations, with their almost absolute economic power to dictate the very quality of life to humanity on a global scale. Few today seem aware that monetary policy, ultimately, is primarily a mechanism for control of the masses by the wealthy (plutocrats) IMNSHO (as I was first informed in "The Art Of War", by Lao Tzu).

Adam Smith, also, came to believe that the gluttony of the rich was a form of "unproductive labour" as do I, but he could not free himself from the philosophical constructs and beliefs of his milieau to make the requisite ratiocinative leap of faith and demographic probability vector calculus summation (not even a concept then) to conclude that this self-defeating flaw in fact would quite logically then imply that capitalism per se would lead to ubiquitous oppression of the poor by the wealthy (read: exploitation of the proletariat by the 'ruling class' - or read some Dickens or Upton Sinclair).

Yet, such is the case today, I humbly avow, for I believe that capitalism has subsumed and thereby actually annulled the basic precepts of democracy, and defeated that noble ideal at least for the present in this republic. Alexander Hamilton and his 'royalists' made sure of that, the prescience of Paine, Jefferson, Madison and Morris notwithstanding.

The electoral college, and our irrational 'representative' (instead of 'participatory') electoral system is 'part and parcel' of that inculcated 'classist' ethical structure. As evidenced in part by the fact the phrase:

Our society was deliberately and with great diligence engineered to be a Plutocratic Oligarchy! NOT a Republic & NOT a Democracy! Seems History can be ignored in general or generally missapprehended even before it is obfuscated and revised with contumely and disdain by the powerful ("History is only the word of the victors").

Anyway, back to the here and now, and the so called "great decline". I just see this as no more that the reality of the inequitable, anti-egalitarian and insufficiently rational nature of capitalism finally becoming apparent to all, based in fact on the vanishing prospects of future generations to live in an economy as opulent and resource wasteful as modern day America.

I have been an Anarcho-Syndicalist since the '60s when I first read Lao Tzu, Thomas Paine, Norman O. Brown and Marshall McLuhan. Thus I knew of the probable gradual decline and inevitable collapse of a system based upon a fundamental error: 'development' as an rationale for acquisition and investment of capital eventually fails when there are no more goods of "real" value to be produced (based on something like, oh say, Maslow's "Hierarchy of Needs") and/or there ceases to be nothing from which anything can be produced. So it has to end sometime, right? This is a well foreseen (if one was paying attention to cutting edge social theorists during the 20th. Century) and evolutionary cultural denoument.

Capitalism is a social and cultural construct, no more. It was not "Divinely" inspired - read Adam Smith's biographers - the dude spent much of his waking life in jocular and animated audible conversations with beings that were not visible to anyone else, and as a Deist never once asserted that his inner voices were divine. Such is the legacy of the social theorist (along with John Locke) who most impressed our Founding Fathers, upon whom in turn much of the mores and folkways, the "gloss". if you will, of our society's interstitial structure depends.

The Founding Fathers did the best with what they knew then, no doubt.

We have the right (and also the duty) to modify this revered, but perhaps obsolete, or rendered less than ideally efficacious, social structure (capitalism) at will if a preponderance of the evidence can be agreed upon by a majority of the voting populace, having thus ascertained our new assertions may provide us with clues to what might modify or amend it to achieve a greater good for a greater number, so where's the beef, eh? "They got the guns, but we got the numbers." said Jim Morrison.

Given the current ossification of political chutzpah and judicious ability to question the 'dogma' of attitudes relevant to the Deists, Masons and tipplers (and make no mistake - almost to a man, the Founding Father's "original intents" were well steeped in rum on a daily basis) who crafted our Constitution, though, I despair at there being a 'populist' solution to this slow decay of "Truth, Justice & The American Way".

Now remember I'm talking here about changing the nature of "capitalism", NOT the Constitution, lest I be accused of being a "Communist" (I am not), or a "Socialist" (I am not, either). The Constitution was, in its ineffable Beauty (yes, I mean the Platonic absolute, because if I worship at any altar, it is at that of the Contitution) designed to evolve, and quite legally and properly, can be changed by a concerted vox populi, applied through the amendment process. It may have to develop the "Taft-Hartley" type teeth that it should have had before the Hamiltonians pulled them to sacrifice all economic justice for the concept of governmental 'laissez faire' practices, I don't know.

As an example, the "Wobblies" - The International Workers of the World, started out as basic Anarcho-Syndicalists (as far as my research has shown). They were of course 'tarred with the same brush" as the 'pinkos' that (I actually use the following word AS DEFINED BY THE OED - which, if everybody adhered to its 'prescriptive' definitions: IOWs - a word means what it meant WHEN FIRST USED IN PRINT; would end these stupid debates over what some vested political interest on either side WANTS the word to mean) . . . Fascist (!) "Tail-Gunner" Joe McCarthy used to forever besmirch the egalitarianism of social theory by anyone other than John Birch. What was lost was the IWW's initial alliance with the "America First" movement ("domestick" economic self-interest as delineated by Smith - see above) and the IWWs noble ideal of freeing mankind from 'wage slavery'.

They also were the only group to hold services yearly for the victims of the "Ludlow Massacre". That occured in 1914 when 19 people were killed (including 2 women AND 12 CHILDREN)! Workers and their families on strike against inhuman working conditions in COAL MINES in Southern Colorado were machine-gunned/burned/asphyxiated/hand-cuffed and beaten to death by THE COLRADO NATIONAL GUARD, sent by the 'ruling class' owners of the mines, ordered to do so with State and Federal complicity, to protect said owner's profit margins (none of the murdering Guardsmen ever served time for their crimes). Why? Because they were doing the bidding of the ruling class! Are mines that much better today? NO, given the vast progress of technology since! Why? Because our society favors greed, and oppresses the poor, as designed. Can the rich still 'buy' more Justice than the poor - You Betcha!

Unfortunately for the proponents of "Free-market growth", economies CANNOT expand forever (unless there really are extra-terrestrials somewhere to whom we can attempt to market our old atom bombs and iPods) because at some point there will be no-where and no-thing left in/to which to expand (unless we colonize space, and seed colonies on habitable planets 'out there', but the vast distances involved, combined with the limitations of light speed on travel, will make commerce irrelevant except in singular cases) .

The current diminution of standard of living was, and is, inevitable, given the finite nature of the biosphere, and the expansion of human population (read: consumers) which will eventually reach an economic "point of diminishing returns" where 'money' will no longer be able to "grow" in "value", because (as you and the' Paul's' , Ron & Rand, so rightly assert) "Treasury Notes" are not based upon the "value" of anything concrete, only the relative productivity (GDP) of the issuant nation-states or corporate hegemonies, AS DEFINED AND MANIPULATED BY THE RULING CLASS (you think the World Bank even cares who is in the White House? NO WAY!) This value will decline as room to grow, and natural resources dissappear.

But NEVER FEAR FOLKS, the 'captains of industry' will devise various and sundry means whereby the populations of "have-nots" will be guaranteed JUST enough of a standard of living as to preclude gross revolution. "Bread and circuses" and "a chicken in every pot" will mollify most into passive acceptance of their diminishing lot, and eventually even the most strident of the "free-trade" crowd will be forced to concede that everyone has enough 'widgets' and 'gizmos' (when the material of which these consumer products are made becomes more valuable than the manufactured items themselves as predicted by Mcluhan).

So, I personally truly see no huge world-wide economic collapse looming because the powers that be will find it in their best interests to continue to delude "man'un'kind" into complacency by manipulating currency standards to prop up this ultimately senseless insistence on 'economic growth'. Or perhaps some plague of global proportions will be engineered to only wipe out those least able, or least favored, to afford consumer products (uh - er - hmmmm - that may have already happened ).

(BTW, I claim copyright to "Probability Vector Calculus" as a means of "remote viewing" most probable futures from my MKULTRA/civilian "Men Who Stare At Goats" type training & "looking down the road" I still don't see it happening as a worldwide catastrophe - gradual decline, yes.)

I have many 'survivalist' friends, though, who have always stockpiled supplies and such and do so to this day. Most of them do it because they still remember their "atomic bomb holocaust" dreams from growing up in the '50s/'60s. Then, there are my old LDS buds in Wyoming, where I helped out at "Freedom Arms" for a couple years. They usually have a year's supply of stuff cached somewhere, just as a matter of principle. "Be Prepared" - Say The Mormon Church & the Boy Scouts. Anything happens, I'm puttin' a couple hundred gallons of gas in the RV and headin' Northeast to the gun plant.

Anyway, I believe perhaps 200 years hence, barring some breakthough in theoretical physics before then, and only then, will things settle into a scant semblance of economic equilibrium, after quite a few people starve, though, and most of the 'heavy metals' and stuff like coltan are mined out.

This hoped for new balance MUST be based upon some notion other then the frightful illogic (see "Life Against Death", by Brown) of:

An admonition which is still keeping the Catholic Church from sanctioning the use of condoms, so the poor can overbreed and starve, or die of diease, because the Vatican asserts that is "God's Will", evidenced by that verse.

This same verse I believe is the 'cause', implanted in the collective conservative subconscious, for the "Religion Of Free Trade" effect, to this day.

You know, this whole "recession" could easily even be a ploy by the ruling class to lower wages, disenfranchise workers with 30 and 40 year of seniority, bust unions and wage economic warfare upon the 'proletariat'. They have done the same and worse in the past. Who was responsible for these inequities in divestable capital in the first place? Poor people or rich people? Think about it. Who gave our manufacturing base and bases to the slave-labor wagemasters of the Third World anyway? That's right, you heard right - the ruling classes!

This is where and when I believe the system of mass control of worldwide human evolution becomes 'self-aware', in a sense, with Locke and Hobbes, and Paine's "Age Of Reason" ; and so, with this contraindicative dipositive dialectic of capitalism, feudalism, with its "Divine Right Of Kings", devolves/evolves into the plutocratic and oligarchical hegemonies that today are nation-states and multi-national corporations, with their almost absolute economic power to dictate the very quality of life to humanity on a global scale. Few today seem aware that monetary policy, ultimately, is primarily a mechanism for control of the masses by the wealthy (plutocrats) IMNSHO (as I was first informed in "The Art Of War", by Lao Tzu).

Adam Smith, also, came to believe that the gluttony of the rich was a form of "unproductive labour" as do I, but he could not free himself from the philosophical constructs and beliefs of his milieau to make the requisite ratiocinative leap of faith and probability vector calculus summation to conclude that this self-defeating flaw in fact would quite logically then imply that capitalism per se would lead to ubiquitous oppression of the poor by the wealthy (read: exploitation of the proletariat by the 'ruling class' - or read some Dickens or Upton Sinclair).

Yet, such is the case today, I humbly avow, for I believe that capitalism has subsumed and thereby actually annulled the basic precepts of democracy, and defeated that noble ideal at least for the present in this republic. Alexander Hamilton and his 'royalists' made sure of that, the prescience of Paine, Jefferson, Madison and Morris notwithstanding.

The electoral college, and our irrational 'representative' (instead of 'participatory') electoral system is 'part and parcel' of that inculcated 'classist' ethical structure. As evidenced in part by the fact the phrase:

Our society was deliberately and with great diligence engineered to be a Plutocratic Oligarchy! NOT a Republic & NOT a Democracy! Seems History can be ignored in general or generally missaprehended even before it is obfuscated and revised with contumely and disdain by the powerful ("History is only the word of the victors").

Anyway, back to the here and now, and the "great decline".
I just see this as no more that the reality of the inequitable, anti-egalitarian and insufficiently rational nature of capitalism finally becoming apparent to all, based in fact on the vanishing prospects of future generations to live in an economy as opulent and resource wasteful as modern day America. I have been an Anarcho-Syndicalist since the '60s when I first read Lao Tzu, Thomas Paine, Norman O. Brown and Marshall McLuhan, thus I knew of the probable gradual decline and inevitable collapse of a system based upon a fundamental error: 'development' as an rationale for acquisition and investment of capital eventually fails when there are no more goods of "real" value to be produced (based on something like, oh say, Maslow's "Hierarchy of Needs") and/or there ceases to be nothing from which anything can be produced. So it has to end sometime, right? This is a well foreseen (if one was paying attention to cutting edge social theorists during the 20th. Century) and evolutionary cultural denoument.

Capitalism is a social and cultural construct, no more. It was not "Divinely" inspired - read Adam Smith's biographers - the dude spent much of his waking life in jocular and animated audible conversations with beings that were not visible to anyone else, and as a Deist never once asserted that his inner voices were divine. Such is the legacy of the social theorist (along with John Locke) who most impressed our Founding Fathers, upon whom in turn much of the mores and folkways, the "gloss". if you will, of our society's interstitial structure depends.

The Founding Fathers did the best with what they knew then, no doubt. WE NOW KNOW MUCH MORE !

We have the right to modify this revered, but perhaps obsolete, or rendered less than ideally efficacious, social structure (capitalism) at will if we as a free people so choose, no matter what a skulk of greedmongers, outnumbered 99 to 1 may say. And that is what they fear, and for what will bend any rule, break any law, buy any judge or politician, rewrite any History book. Look at what happened to Allende in Chile, for example, or the US invasion of Costa Rica because the price of bananas went up a dime for the popular benefit of its citizens. This stuff still goes on, and it is so sad because the wealthy are trying to combat Entropy itself, and they honestly can never win. If a preponderance of the evidence can be agreed upon by a majority of the voting populace, having thus ascertained our new assertions may provide us with clues to what might modify or amend it to achieve a greater good for a greater number, where's the beef, eh? "They got the guns, but we got the numbers." as Jim Morrison said.

Given the current ossification of political chutzpah and judicious ability to question the 'dogma' of attitudes relevant to the Deists, Masons and tipplers (and make no mistake - almost to a man, the Founding Father's "original intents" were well steeped in rum on a daily basis) who crafted our Constitution, though, I despair at there being a 'populist' solution to this slow decay of "Truth, Justice & The American Way".

Nevertheless, economies CANNOT expand forever (unless there really are extra-terrestrials somewhere to whom we can attempt to market our old atom bombs and iPods) because at some point there will be no-where and no-thing left in/to which to expand (unless we colonize space, and seed colonies on habitable planets 'out there', but the vast distances involved, combined with the limitations of light speed on travel, will make commerce irrelevant except in singular cases).

The current diminution of standard of living was, and is, as I say, inevitable, given the finite nature of the biosphere, and the expansion of human population (read: consumers) which will eventually reach an economic "point of diminishing returns" where 'money' will no longer be able to "grow" in "value", because (as you and the 'Paul's', Ron & Rand so rightly assert, Denise) it is not based upon the "value" of anything concrete, only the productivity (GDP) of the issuant nation-states or corporate hegemonies, which will decline as room to grow, and natural resources dissappear.

But never fear, the 'captains of industry' will devise various and sundry means whereby the populations of "have-nots" will be guaranteed JUST enough of a standard of living as to preclude gross revolution. "Bread and circuses" and "a chicken in every pot" will mollify most into passive acceptance of their diminishing lot, and eventually even the most strident of the "free-trade" crowd will be forced to concede that everyone has enough 'widgets' and 'gizmos' (when the material of which these consumer products are made becomes more valuable than the manufactured items themselves as predicted by Mcluhan).

I see no huge world-wide economic collapse looming, because the powers that be will find it in their best interests to continue to delude man'un'kind into complacency by manipulating currency standards to prop up this ultimately senseless insistence on 'economic growth'. Or perhaps some plague of global proportions will be engineered to only wipe out those least able, or least favored, to afford consumer products (uh - er - hmmmm - that may have already happened ).

Then, perhaps 200 years hence, barring some breakthough in theoretical physics before then, and only then, will things settle into a scant semblance of economic equilibrium, based upon some notion other then the illogic of: "Be fruitful, and multiply, and fill the Earth." (see "Life Against Death",by Brown) when even a fool such as I can see we're faced with obviously finite room, and resources.

It's kinda' like what another whacko such as I once said to me long ago when I mused then (during the anxiety of the Energy Crisis of the '70s) upon much the same issue/argument as you have raised here, Denise, my esteemed 'sister':
